Terms of Use

By registering on our website and by using our services, you agree to all of our following terms of service agreements. In the event you are not legally allowed to enter into contracts and/or service agreements, your parents and/or legal guardians must agree to these terms and must also enforce them. Failure to follow our terms of service will result in the termination of your account, and possible legal action will be taken depending on the severity of the situation. It is in your best interest to follow our guidelines for our website, and while using our service to avoid the termination of your Ticuto account. We also ask that if you are under the age of 16 you inform your parent/guardian of these terms and conditions before you agree to abide by them. If you have any concerns regarding our terms and conditions or if you need clarification on anything, please contact us.

Behavioral Standards

By using our services, you agree that you will not:

  1. Harass, threaten, stalk, or abuse any member of Ticuto, or discriminate based upon their race, gender, beliefs, or other characteristics or opinions.
  2. Use our service for advertising, chain letters, surveys, questionnaires, and spam.
  3. Advertise or sell any goods or services, including but not limited to any virtual items that can be obtained in Ticuto.
  4. Violate our code of conduct.
  5. Send inappropriate material that is likely to cause harm or offense, such as sexual acts, acts of violence, or material promoting discrimination.
  6. Break the law.
  7. Impersonate the identity of a staff member, or of any individual.
  8. Refuse to follow the rules or instruction of any Ticuto Staff member or someone of legal authority.
  9. Distribute files that contain harmful computer viruses, worms, corrupted files, trojans, or any similar programs that might cause harm or damage to an individual’s computer.
  10. Distribute any copyrighted material.
  11. Spread any individual’s personal information or details.
  12. Attempt to gain unauthorized access to any Ticuto systems.
  13. Attempt to obtain any personal information from any individual of Ticut.
  14. Access any accounts other than your own as well as share an account with other players
  15. Use 3rd party applications with Ticuto.
  16. Post tutorials (video/audio/text-based) on how to exploit the game in any way.
  17. Share any inappropriate images or links within Ticuto that are offensive, contain nudity, malicious, pornographic, or illegal, or do that does not fall within the PG category.
  18. Avoid our profanity filter and/or use profanity/vulgar language within the game or while on the website.

Account Security

The security of your Ticuto accounts and password is your own personal responsibility. In order to keep this information safe you must not share it with anyone. If you have any suspicion that your details have become available to another person, it is your responsibility to contact us so that we may take the appropriate precautions in protecting your account from being harmed.

All accounts are personal and are to be used only by the creator of the account. Shared accounts are not permitted in Ticuto. Any accounts found to be shared will be permanently banned from accessing our services without any notification or refund.

Registration Age

To use any of the services we offer at Ticuto, you must be at least 13 years of age or older. Our game is not intended for the use of any individual under the age of 13 and we reserve the right to ban any user thought to be under our minimum age requirement.

Your Account

By registering an account with Ticuto you agree that all information provided is valid and accurate. It is your responsibility to contact us if any changes take place in regards to the details that were provided when the account was created.

If by chance you forget or lose the password to your Ticuto account, you may use the password retrieval facilities we have in place. Ticuto has the right to ban any account usernames that are deemed inappropriate.

Ticuto reserves the right to temporarily ban, permanently ban, and delete any account for any reason at any time, without any prior warning to the owner of the account. Refunds will not be given under any circumstances.

Email Verifications

All accounts on Ticuto must verify their email address to protect the integrity of Ticuto. Unverified accounts are subject to termination after a period of six months. In the event the user never receives a verification email, the user must contact Ticuto via the Help Tool and/or emailing [email protected] to manually verify his or her email address. If the end user never verifies his or her email, but also has made a purchase, no refunds will be given.

Inactive Accounts

Ticuto reserves the right from time to time to delete user accounts that have been inactive for over 6 months. This means that your account will be completely removed from Ticuto’s database system along with any items and/or gold on the account. Inactive accounts are deleted to ensure the speed and quality of our service.

Commercial Use

Ticuto is intended only for the use of individuals for entertainment purposes. Commercial use of our service is not allowed without prior permission from the Ticuto team.

Website Content

This agreement (“Agreement” or “Terms of Use”) between you and Ticuto. Ticuto sets forth the terms and conditions which apply to the use by you of www.ticuto.com (however accessed and/or used, whether via personal computers, mobile devices or otherwise) and other interactive features or downloads (e.g., widgets) that are accessible on or downloadable through, or related to, www.ticuto.com and owned or operated by Ticuto or and any other product or service offered by Ticuto for use, subscription or sale (collectively, “Services”). Subject to the terms and conditions below, and your acceptance of them, Ticuto agrees to grant, and you agree to take, a non-exclusive, non-transferable, single computer license to use and display the Services and related software (excluding source and object code) for your personal (or household) non-commercial use by any machine( s ) of which you are the primary user (“Limited License”). Without limiting the forgoing, you agree not to use the contents of Services for any other use or purpose. You further agree that you will not, and will not attempt to, copy or distribute the content of the Services to any other person unless specifically permitted by Ticuto or otherwise violate the single computer, non-commercial display and use Limited License granted hereunder. Ticuto reserves the right to modify the license granted in this section and the restrictions described in these Terms of Use in writing on the Site, including, without limitation, by charging fees therefor and/or making certain features available through the Site that may invite you to use the Site Materials in a manner not described in these Terms of Use. Ticuto may add, change, discontinue, remove or suspend any of the Site Materials (defined below) at any time, without notice and without liability. The Site is intended for an audience that is at a minimum thirteen (13) years of age; some content may be deemed inappropriate by some parents for teenage audiences. Parental guidance is recommended.

If you do not understand and accept these Terms of Use, do not use the Services. Your use and/or continued use of the Services shall be deemed to constitute your acceptance of these Terms of Use and all of Ticuto’s rules and restrictions related to the Services, as they may change from time to time.

Disputes With Others

You are solely responsible for your interaction with others that you come in contact with through the Site. However, we reserve the right, but have no obligation, to monitor and/or manage disputes between you and other users of the Site. If you have a dispute with other users, you release Ticuto and all staff from claims, demands, and damages (actual and consequential) of every kind and nature, known and unknown, arising out of or in any way connected with such dispute.

Additions and Changes

You agree to review these Terms of Use on at least a weekly basis to be aware of Changes (as defined herein).

Ticuto has the right, at any time, to:

  1. add, change or discontinue the Site or Services, or any aspect or feature of the Site or Services, including, but not limited to, content, financial terms, availability and equipment needed for access or use
  2. impose, change or modify its terms and conditions applicable to your use of the Services, or any part thereof
  3. to impose, change or modify the terms and conditions of these Terms of Use (“Changes”). Such Changes shall be effective immediately upon notice by posting the Changes on Ticuto’s Services or by any other method of notice Ticuto deems appropriate. Any use of the Services by you after notice of the Changes, constitutes acceptance by you of such Changes.

Code of Conduct

  1. Do not harass, threaten, stalk, abuse, or discriminate against any member of Ticuto.
  2. Do not take part in or distribute inappropriate material such as sexual acts, or acts of violence.
  3. Do not steal or scam user’s items, gold, passwords or accounts.
  4. Do not advertise or sell any goods or services, including virtual items/accounts obtained in Ticuto.
  5. Keep your personal details a secret and don’t try to gain personal information from other users.

Bug Abuse

Any bugs or errors which you find in our service should immediately be reported to Ticuto through our Player Support system. You agree not to use any bugs and/or exploits for any reason. Any exploitation, hacking, and/or attempt to purposefully cause damage to our server will result in a permanent ban from our services and/or network.

Purchases

All purchases are final and no refunds will be given under any circumstances. In the event that a transaction is reversed and/or cancelled, the user who redeemed the purchase will be permanently banned. In the event of a security breach, Ticuto and it’s staff cannot be held liable for any damages, including, but not limited to stolen gold, stolen virtual goods, etc.

Definitions

Personal Information is defined as information that can be used to uniquely identify, contact, or locate a single person or can be used with other sources to uniquely identify a single individual. It includes, but is not limited to: Home Address, Phone Number, Social Security Number, NIS or NHS number, Credit Card numbers, Drivers License number, birthdate, vehicle identification numbers, etc. [wiki].

These Terms of Service are governed by the laws of the state of California in the United States.
